Công ty em có 3 người tham gia BHXH với mức lương là 620.000đ, hiện nay có 1 người nghỉ đẻ, thì tính BHXH cho người ấy như thế nào và cả 2 người kia nữa. Có gì mọi người giúp em với. Khoản 2% giữ lại là như thế nào. Em không hiểu gì hết.

 Theo khoản 2 điều 35 Luật bảo hiểm xã hội thì trong thời gian nghỉ thai sản người lao động và người sử dụng lao động không phải đóng BHXH. Việc chi trả chế độ BHXH cho người này do cơ quan BHXH thực hiện, công ty bạn không bắt buộc phải chi trả khoản tiền nào.
Những người còn lại vẫn tiếp tục tham gia BHXH với mức đóng dựa tr ên mức lương ghi trong hợp đồng lao động./.
